Terms of Service

1. Acceptance of Terms

By accessing or using Field-Ready ("the platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the platform. We may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. We will notify active subscribers of material changes by email at least 14 days before they take effect.

2. Eligibility

You must be at least 18 years old to use Field-Ready. By using the platform, you represent that you meet this requirement. Field-Ready is intended for working professionals and individuals pursuing careers in building automation, HVAC controls, and related trades. We reserve the right to refuse service to anyone for any reason.

3. Accounts and Membership

• ·Account registration and billing are handled by Memberful. By subscribing, you also agree to Memberful's terms of service.
• ·You are responsible for maintaining the confidentiality of your account credentials. Do not share your login with others.
• ·Each subscription is for a single user. Access may not be shared, transferred, or resold.
• ·You are responsible for all activity that occurs under your account.
• ·We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Billing

• ·Field-Ready is offered on a recurring subscription basis. Your subscription will renew automatically at the end of each billing period unless you cancel.
• ·You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period.
• ·We do not issue refunds for partial billing periods or unused time remaining after cancellation.
• ·We reserve the right to change subscription pricing. Active subscribers will be notified of price changes at least 30 days in advance. Continued use after the effective date constitutes acceptance of the new pricing.
• ·If a payment fails, we may suspend access to your account until the outstanding balance is resolved.

5. Permitted Use

Field-Ready grants you a limited, non-exclusive, non-transferable license to access and use the platform for your personal, non-commercial learning and professional development. This license is conditioned on your compliance with these terms.

• ·Use the platform only for lawful purposes
• ·Not reproduce, distribute, resell, or sublicense any platform content
• ·Not share your account credentials with any other person
• ·Not attempt to reverse-engineer, scrape, or copy the platform or its content
• ·Not use the platform in any way that could damage, disable, or impair its operation

6. Intellectual Property

All content on Field-Ready — including lessons, diagrams, simulators, exercises, written materials, and software — is owned by Field-Ready or its licensors and is protected by applicable intellectual property laws. Nothing in these terms transfers any ownership rights to you. Your subscription gives you access to the content; it does not give you ownership of it. You may not reproduce, publish, or distribute any platform content without our prior written consent.

7. Disclaimers

Field-Ready is provided for educational and professional development purposes. While we aim for accuracy, the platform does not constitute professional engineering advice, and Field-Ready makes no warranties that the content is complete, error-free, or appropriate for every situation. Building systems vary significantly. Always follow applicable codes, manufacturer specifications, and site-specific procedures. Field-Ready is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Field-Ready and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of data, loss of profits, or personal injury. In no event shall our total liability to you exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Field-Ready and its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, if we believe you have violated these terms or if continued access would harm the platform or its users. Upon termination, your right to use the platform ceases immediately. Sections 6, 7, 8, and 9 survive termination.

11. Governing Law

These terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts.
